The deal, in writing.

The short version

  • You get a license to use the app; you don't own the code, and you can't resell or redistribute it.
  • Your API keys, accounts and costs are yours. What you spend with Anthropic, OpenAI or others is between you and them.
  • Third-party tools have their own rules. Embedding Midjourney in a tab doesn't change your agreement with Midjourney.
  • The software is provided as-is. We work hard on it, but we can't guarantee embedded tools won't change or break.

1. Agreement

These terms govern your use of the Console.app website (console.app) and, once released, the Console.app macOS application (together, the "Services"). By using the Services, you agree to these terms. If you don't agree, don't use the Services. We operate from Sydney, Australia, and these terms are governed by the laws of New South Wales, Australia.

2. The website and waitlist

The website is provided free of charge for information and early-access sign-up. Joining the waitlist doesn't create any obligation on either side: we're not obliged to launch, offer you a place, or hold pricing, and you're not obliged to buy anything. Waitlist perks (such as founding-member pricing) are offered at our discretion and described at the time of launch.

3. Your license to the app

When you purchase or otherwise lawfully obtain Console.app, we grant you a personal, non-exclusive, non-transferable license to install and use the app on Apple devices you own or control, for your own use (including commercial creative work you produce with it). You may not:

  • copy, resell, rent, sublicense or redistribute the app or your license key;
  • reverse engineer, decompile or modify the app, except where law expressly permits it;
  • use the app to build a competing product by copying its non-public implementation;
  • circumvent license validation or trial limits.

Content you create using the app — prompts, scripts, images, audio, video — is yours (subject to the terms of the AI providers and tools that generated it). We claim no ownership over your output.

4. Bring-your-own keys and accounts

Console.app works by connecting to AI providers and web tools using your own accounts and API keys. That means:

  • You are responsible for the costs those providers charge you, including API usage fees. Usage initiated through Console.app is billed by your provider under your agreement with them.
  • You are responsible for keeping your keys and logins secure on your device, and for complying with each provider's terms of service and usage policies.
  • If a provider suspends your account or changes their API, we are not responsible for the resulting loss of functionality.

5. Third-party tools and embedding

The app can display third-party websites (such as Midjourney, ElevenLabs, Runway, Figma) inside tabs. These services are not ours: their availability, behaviour, terms and pricing are controlled by their operators, and your use of them through Console.app remains subject to their terms. Some sites limit or prohibit embedding; where a site blocks embedding, the app falls back to clipboard copy. We don't guarantee that any particular third-party tool will remain embeddable or that auto-fill will keep working as those sites change.

6. Acceptable use

You agree not to use the Services to violate any law, to infringe others' rights, to generate or distribute unlawful content, or to interfere with the operation of the Services or any third-party service accessed through them. You're responsible for ensuring the content you create and route through the app complies with the policies of the AI providers and tools you use.

7. Trials, pricing and refunds (from launch)

Pricing, trial terms and any refund policy will be stated at the point of purchase when the app launches, and are handled through our payment provider. Where you buy through a payment provider, its checkout terms also apply. Nothing in these terms limits any non-excludable rights you have under the Australian Consumer Law, including consumer guarantees.

8. Disclaimers

To the maximum extent permitted by law, the Services are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted or error-free, that embedded third-party tools will continue to function or permit embedding, or that AI-generated output will be accurate or suitable for your purposes. AI output can be wrong: review it before you rely on it.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, loss of profits, data or goodwill arising from your use of the Services. Our total aggregate liability for claims relating to the Services is limited to the amount you paid us for the app in the 12 months before the claim arose (or AUD $50 if you paid nothing). Nothing in these terms excludes liability that cannot be excluded under applicable law, including under the Australian Consumer Law.

10. Termination

You can stop using the Services at any time. We may suspend or terminate your license if you materially breach these terms and (where the breach can be fixed) don't fix it within 14 days of us telling you. Sections that by their nature should survive termination — including licenses to your content, disclaimers and liability limits — survive.

11. Changes

We may update these terms as the product evolves — for example, when purchasing launches. We'll update the date at the top and, for significant changes, notify waitlist subscribers or in-app. Continued use after changes take effect means you accept them.
